Content provided by the User
Users are responsible for their own content and third-party content that they share on Harmony, by uploading it, posting content or by any other means. Users indemnify the Owner from any liability regarding the unlawful dissemination of third-party content or the use of Harmony in ways that violate the law.
The Owner does not moderate the content published by the User or third parties but undertakes to intervene following reports from Users or orders issued by public authorities regarding content deemed offensive or illegal.
Rights over content provided by Users
The only rights granted to the Owner regarding the content provided by Users are those necessary for the operation and maintenance of Harmony.
Registration
To use the Service or parts of it, Users must register by providing, truthfully and completely, all the data requested in the relevant registration form and fully accept the privacy policy and these general conditions. The User is responsible for safeguarding and keeping their access credentials confidential.
Account termination and deletion
Registered Users can disable their accounts, request their deletion, or stop using the Service at any time, through the Harmony interface or by contacting the Owner directly.
The Owner, in case of violation of these Terms, reserves the right to suspend or terminate the User's account at any time and without notice.
Purchase
Purchase procedure
The User must select the products and proceed to checkout, after carefully verifying and possibly modifying the information contained in the order summary. The order is placed by confirming it and is subject to payment of the price, taxes, and shipping and payment costs indicated in the order summary form. Each submitted order constitutes an offer to purchase the products. Orders are subject to availability and the Owner's discretionary acceptance.
The Order Processing Receipt does not constitute acceptance of the order. The contract is concluded when the Owner sends the Order Confirmation to the email address provided by the User. The Owner reserves the right not to confirm an order, communicating to the User within 20 days of purchase, at the email address associated with their purchase, the possible unavailability of one or more of the purchased products. In this case, the Owner will refund the price and shipping costs incurred by the User.
Product Availability
The prices, descriptions, or availability of the products displayed are subject to change without notice by the Owner. The photos included are indicative of the related products and do not constitute a guarantee of the qualities and perfect correspondence of the products, especially regarding color.
Order Execution
The Order is executed within the terms specified in the summary page and in the Order Confirmation email, subject to the availability of the ordered product.
The Owner cannot be held responsible for damages suffered by the User due to delivery delays that are not dependent on circumstances foreseeable by the parties at the time the Order Confirmation was sent.
Delivery
Deliveries are made during normal working hours to the address indicated by the User and according to the methods specified in the order summary.
Upon delivery, the User must verify the content, specifying any anomalies on the delivery form.
In case of failure to collect within the deadline set by the carrier, the products will be returned to the Owner, who will refund the price of the products but not the shipping cost. The Owner cannot be held responsible for delivery errors due to inaccuracies or incompleteness in the completion of the purchase order by the User, for any damage occurred to the Products after delivery to the carrier, where the latter has been chosen and appointed by the User, or for delays in delivery attributable to the latter.
Right of Withdrawal
In case of purchase of products or services on Harmony.it, the User has the right to withdraw from the contract without giving any reason, within 14 days. The withdrawal period expires 14 days after the day on which the User or a third party – other than the carrier and indicated by the User – acquires physical possession of the goods. To exercise the right of withdrawal, the User is obliged to inform the Owner of their decision to withdraw via an explicit statement sent to the indicated contacts.
Effects of withdrawal
If the User withdraws from this contract, all payments made to the Owner will be refunded, including delivery costs (except for supplementary costs arising from the choice of a type of delivery other than the least expensive type of standard delivery offered) without undue delay and in any case no later than 14 days from the day on which the Owner is informed of the User's decision to withdraw from this contract. Said refunds will be made using the same payment method used by the User for the initial transaction, unless the User has expressly agreed otherwise; in any case, the User will not incur any fees as a result of such reimbursement. The refund may be suspended until receipt of the goods or until the User has demonstrated having sent back the goods, whichever is earlier.
The User is requested to send back the goods and hand them over to the Owner without undue delay and in any case within 14 days from the day on which they communicated their withdrawal from this contract. The deadline is met if the User sends back the goods before the 14-day period has expired. The costs of returning the goods will be borne by the User. The User is only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Limitations to the right of withdrawal on products
Products that are damaged or used, even partially, will not be replaced or refunded. The User must include a copy of the delivery document received inside the packaging box.
The right of withdrawal does not apply: to goods made to the consumer’s specifications or clearly personalized or which are liable to deteriorate or expire rapidly, are sealed and not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
Warranty
The consumer User is entitled to a warranty on the conformity of the purchased products and services. The warranty lasts for 24 months from the delivery of the goods, and the lack of conformity must be communicated to the Owner within 2 months of its discovery.
To exercise the warranty right, the User must send an email to the Owner, mandatorily indicating the order number and an accurate description of the defect (attaching photographic material is also recommended).
All elements are essential and will be verified by the Owner before responding to the User.
If the lack of conformity of the product is confirmed, the User has the right to obtain, after returning the defective product to the Owner, its repair or replacement. The User also has the right to request an appropriate price reduction from the Owner or the termination of the contract if repair and replacement are impossible or excessively burdensome, the Owner has not repaired or replaced the goods within a reasonable time, or the previously performed replacement or repair has caused significant inconvenience to the User.
To exercise the warranty right and for further information on the matter, the User is required to contact the Owner.
